Veterans Memorial Pool Party (Weekend)

On behalf of myself and/or the company/organization I represent, as well as all involved, I hereby: 1. Agree to assume all risk of damage to the facility as a consequence of its use; 2. Waive, release and discharge, the West Fargo Park District, it’s agencies, officers, employees and volunteers from any and all liability they may incur resulting from the use of the facility; 3. Indemnify, save and hold harmless the West Fargo Park District, it’s agencies, officers, employees and volunteers from any and all claims of any nature, including costs, expenses and attorney fees which may in any manner result from the use of the facility; 4. Recognize that photos or video taken during any activity or program are the property of the Park District and may be used without any compensation to me, prior notice, or additional permission; 5. Understand the hazards of the novel coronavirus (COVID-19) and accept full responsibility for familiarizing myself with the most recent updates of guidelines. Despite the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to rent a West Fargo Park District facility and accept full responsibility for all involved. During my West Fargo Park District rental, I agree to and will ensure all involved will follow, guidelines provided by the Centers for Disease Control and Prevention (CDC) and the North Dakota Department of Health (NDDoH). All involved is in reference to any persons in attendance during your rental. This may include, but is not limited to players, teams, spectators, officials, volunteers, party guests, and/or program participants. This waiver, release and indemnification shall be construed broadly to provide a waiver, release, and indemnify to the maximum extent permissible under applicable law.
