Special Circumstances: In rare cases involving medical emergencies, family emergencies, or other extenuating circumstances, we may offer a one-time credit toward a future visit at our sole discretion. Credit requests must be submitted within 48 hours of your scheduled session to lacasaplayroom@gmail.com with supporting documentation. I, and as parent or legal guardian of the child (or children) whose name (s) are set forth above (each referred to as a “Participant” and collectively referred to herein as the “Participants”) and in consideration of being allowed to participate in activities at La Casa Playroom, LLC ("the Playroom"), located at 4371 S. Archer Ave, Chicago, IL 60632, the undersigned, agree as follows: 1. Activities – Activities shall be defined as the various activities and services offered to Participants by La Casa Playroom, LLC including but not limited to the following: use of the toys and equipment in the Playroom, whether under care of parent(s) and/or if child(ren) are left under care of La Casa Playroom LLC without parental or adult supervision. 2. I understand that the employees of La Casa Playroom, LLC are not responsible for Participants who utilize the space and it is the responsibility of the undersigned individual to supervise any minors they bring into the facility. 3. I, and the children under my care, understand and agree to the safety rules and play guidelines as outlined by La Casa Playroom, LLC. (I assume you have play guidelines posted at the facility or on a website) I acknowledge that these rules and guidelines may change and that I have read and am familiar with them prior to entering the play space and making use of the facility. 4. COVID-19 WARNING An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are extremely vulnerable. By visiting La Casa Playroom, LLC, you voluntarily assume all the risks related to COVID-19. 1. Assumption of Risk In addition to the inherent risk of exposure to COVID-19, I also understand that the use of playroom facilities, toys, and activities at La Casa Playroom entail the risk of severe bodily injury to the Participants. Injuries that could result may vary, but may include falls, minor injuries such as scratches, bruises and sprains, major injuries such as eye injury or loss of sight, joint or back injuries and concussions, or catastrophic injuries, including paralysis and even death. In addition, accidents that may occur during participation in play, games, or other activities. I voluntarily assume all risks related to the use of the Playroom’s facilities and activities. I understand that La Casa Playroom, LLC cannot eliminate all risks or guarantee the safety of the Participants while Participants participate in the activities. I have made my own investigation of these risks, understand these risks, and assume them willingly and knowingly on behalf of myself and my minor Participant child. Notwithstanding these risks and other hazards that may be foreseeable but not specifically identified herein, I, for myself and any minor Participant child, and our respective heirs, personal representatives and assigns, understand, acknowledge, and expressly and voluntarily assume all risks and full responsibility for any sickness or injury arising out of or related to the activities at La Casa Playroom, LLC. 2. Waiver of Liability To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue La Casa Playroom, LLC, its owners, employees, agents, volunteers, or affiliates ("Releasees") from any and all liability, claims, demands, actions, or causes of action, including but not limited to, personal injury, illness, death, or property damage, which may arise from my or my child’s participation in activities or use of the facilities. 3. Indemnification I agree to indemnify, defend, and hold harmless La Casa Playroom, LLC, its owners, employees, agents, volunteers, and affiliates from any and all claims, damages, and expenses, including attorney fees and costs, arising out of or in connection with my or my child’s participation in activities at the Playroom, whether caused by the negligence of the Releasees or otherwise. 4. Medical Consent In case of emergency, I give permission for the Playroom staff to seek medical attention for myself or my child, as deemed necessary, and I understand that I am responsible for any costs associated with medical treatment or transportation. 5. Photographic Release I consent to the use of any photographs, video, or sound bites taken of myself or my child during activities at La Casa Playroom for any legal use including but not limited to marketing, promotional, web content, or educational purposes. I understand that no royalty or other compensation shall be payable to me or my child by reason of such use. 6. Health and Safety I affirm that I or my child do not have any medical conditions or disabilities that would prevent safe participation in activities at La Casa Playroom. I agree to immediately inform La Casa Playroom of any known allergies, medical conditions, or other special requirements that may affect participation. 7. Governing Law This Waiver and Release of Liability shall be governed by and construed in accordance with, and all disputes hereunder shall be controlled by the laws of the State of Illinois. Any disputes arising from this agreement shall be resolved in the appropriate court located in Cook County, Illinois. 8. Acknowledgment of Understanding I hereby certify that I am the parent or legal guardian of the minor Participant children whose name(s) appear below, and I have authority to waive rights on behalf of the minor Participant(s). I have read and I understand all of the provisions of this document and the risks of the activities. I understand that the activities could cause injury and even death. I acknowledge that I have read and understand the terms of this document and I am freely and voluntarily signing this document. I understand that this waiver will prevent me or my child from filing any claims against La Casa Playroom, LLC, its owners, or staff, even if negligence or other fault is involved. This Waiver and Release of Liability has no expiration date.
